Information clause regarding personal data protection

In accordance with art. 13 sec. 1-2 of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) ("GDPR") please be advised that:

I. The Administrator of your personal data is: KOIMEX S.A. with its registered office in Świebodzin, ul. Kozia 3, 66-200 Świebodzin. You can contact us via e-mail gdpr@koimex.pl or in writing to the address of our registered office specified above.

II. Purposes and basis of processing. We will process your personal data:

  1. to conclude and execute agreements (basis: art. 6 sec. 1 letter b GDPR).
  2. to implement our legal obligations and rights (basis: art. 6 sec. 1 letter c GDPR) arising from generally applicable legal provisions, in particular: Civil Code, Transport Law, Convention on the Contract for the International Carriage of Goods (CMR), Road Transport Act, Road Traffic Act, Public Procurement Law, Tax Ordinance Act.
  3. to provide service, understood as ongoing activities related to data processing that are not intended to conclude a contract, including for the purpose of presenting an offer or for marketing purposes, to establish cooperation or contact, and/or to execute a contract concluded with us, which constitutes implementation of our legally legitimate interest (basis: art. 6 sec. 1 letter f GDPR).
  4. for archiving (evidence) purposes, which constitutes implementation of our legitimate interest in securing information in the event of a legal need to prove facts, in particular in the context of administrative, judicial, tax and audit proceedings (basis: art. 6 sec. 1 letter f GDPR).
  5. to carry out debt collection of claims due to us, which constitutes implementation of our legitimate interest (basis: art. 6 sec. 1 letter f GDPR).
  6. to potentially determine, assert or defend ourselves against claims, which constitutes implementation of our legitimate interest (basis: art. 6 sec. 1 letter f GDPR).
  7. for analytical and statistical purposes, which constitutes implementation of our legitimate interest (basis: art. 6 sec. 1 letter f GDPR).

III. Right to object.

You have the right to object to the processing of your data processed for the purpose and on the basis of the above indicated at any time. We will stop processing your data for these purposes, unless we are able to demonstrate that there are valid, legitimate grounds that override your interests, rights and freedoms or your data will be necessary for us to determine, assert or defend claims.

You have the right to object to the processing of your data for direct marketing at any time. If you exercise this right - we will stop processing your data for this purpose.

IV. Data storage period.

Due to the statutory limitation period of tax liabilities and the period of storage of tax books, we will store your personal data for 6 years and 6 months after obtaining your data.

V. Recipients of your data.

Your personal data may be transferred to entities with whom we cooperate in the scope of our processes, with which we have signed agreements entrusting the processing of personal data (accounting office, IT) or who are contractually obliged to comply with the provisions on the protection of personal data.

VI. Rights of data subjects:

In compliance with the GDPR, you have the right to:

  1. access your data and receive its copy;
  2. rectify (correct) your data;
  3. delete, limit processing or object to the processing of your data;
  4. transfer your data;
  5. lodge a complaint to the supervisory body.

VII. Information on the voluntary provision of data

Providing your data is:

  1. necessary for the performance of activities and contracts, statutory obligations referred to in items II.1 - II.6;
  2. voluntary for the purposes referred to in item II.7, and in terms of providing data for marketing purposes or establishing cooperation/contacts.

VIII. Consent and information about the possibility of withdrawing consent

You have the right to withdraw your consent to the processing of your personal data at any time. Such withdrawal of consent does not affect the lawfulness of the processing of personal data that was carried out on the basis of your consent before its withdrawal. In addition, withdrawal of consent does not apply if we fulfill our obligations required by law or it may lead to our refusal to fulfill our contractual obligations.
